I have had a look on some Spanish sites and all seem to agree that at legal level it is required to have the stickers, even if you are a tourist or "in transit" through France.
The original wording of the law seems to say "all helmets worn in France", no concession to visitors.
The ECJ has many times deemed that individual member states can impose stricter regulations than the basic EU requirements issued through EU Directives.
I have to say though, that I love the comment in the first link "the current French socialist president, François Hollande, has no interest other than stealth tax everyone in that country to fund the huge public deficit, so this piece of legislation, which has been in place for some time, is unlikely to be scrapped."
So, it was the socialist government to blame for this becasue they didn't scrap a law that has been in the French highway code for over 25 years !! You couldn't make it up could you?

I'm gong to France this year on my GSX-R, and possibly Spain as well, but I don't really want to put stickers on my lid. I have never been stopped for not having them fitted; I have been stopped for other things, but that is another story...
... I don't think that I'll bother.

Stick a few in your bag maybe - if you get stopped and have some to use hopefully you'd be fine |

Apparently, carrying breathalysers are also compulsory in France. The fine for not carrying them has been ditched, but by law it's compulsory to do so!
